By accessing or using the Vapely Enforcement Intelligence platform (“the Platform”) at enforcement.mercurylabs.ca, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Platform.
The Platform is operated by Mercury Labs (“we,” “us,” or “our”).
The Platform is provided exclusively to authorized law enforcement personnel, Attorney General offices, regulatory agencies, and other government bodies (“Authorized Users”) for the purpose of regulatory compliance monitoring and enforcement of laws governing the sale of electronic nicotine delivery systems (ENDS) and related tobacco products.
Access credentials are non-transferable. You may not share your login credentials with any other person. You are responsible for all activity that occurs under your account.

Audit data is collected via automated scanning of publicly accessible websites. While we strive for accuracy, the Platform does not guarantee that all data is current, complete, or free of error. Audit results should be independently verified before being used as the sole basis for enforcement action.

All software, design, trademarks, and proprietary methodology underlying the Platform are the exclusive property of Mercury Labs. You are granted a limited, non-exclusive, revocable licence to access and use the Platform solely for the purposes described in Section 3. No other rights are granted.
To the maximum extent permitted by applicable law, Mercury Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed CAD $100.
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms or if your authorization to access the Platform is revoked by your agency.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.
